On July 18th, 2008, WorkComp Solutions, Inc. held our first annual, Views from the Bench, A Summer Educational Session at Jackson’s Bistro in Tampa. Our powerhouse line-up of speakers presented some very interesting and helpful information. Below are the highlights presented by our distinguished panel of Insurance Professionals:

Three things must be met in order for fraud to exist

1. “knowingly make or cause to be made,”
2. “Any false, fraudulent, or misleading oral or written statement”
   
3. “for the purpose of obtaining or denying an benefit or payment”
   

The importance of placing the fraud statement on documents including the checks paid to injured workers while working light duty or if you are paying wages in lieu of the carrier paying wages
Fraud is all or nothing, meaning if the file is deemed fraudulent by Judge or Department of Insurance Fraud, all further benefits are denied even when accident is compensable
If you report fraud, you are immune from liability unless reported in bad faith
You cannot threaten fraud to help your case

It challenged the constitutionality of the 2003 amendments to the Florida Statute 440.34
Referenced the guideline attorney fees based on the percentage of benefits obtained and eliminated a fee based upon an hourly rate
The attorneys argued that the Florida Statute 440.34 (2003) violates the injured worker’s right to equal protection

Is there probable cause to believe that a violation of criminal statute has occurred
To find fraud is criminal and therefore goes in front of a jury
For a jury to find fraud is a lot harder than the Judge of Compensation Claims
Make sure to check certificates of insurance online for all subcontractors even when certificate has been presented to you
Make sure you are completing I-9’s on all employees upon hire

Do not be afraid to admit that you have made a mistake
When testifying look the Judge in the face and not the Attorney who is asking the questions
Check with your attorney on what information is privileged or not before bringing to trial
Be aware of embedded documents when sending a file electronically
People can forget minor incidents in their lifetime
Credibility is a huge issue
Make sure your testimony matches the documents admitted into evidence
